1. Agreement to These Terms

These Terms and Conditions, together with any policies, notices, estimates, proposals, contracts, work orders, invoices, and written agreements that reference them, govern your access to and use of UniversityPainters.com and any related pages, forms, content, tools, and online features, collectively referred to as the “Site.”

By using the Site, requesting an estimate, submitting a form, scheduling a consultation, communicating with University Painters, or purchasing services from a participating location, you agree to these Terms. If you do not agree, do not use the Site or submit information through it.

2. About University Painters and Local Service Providers

University Painters provides information about residential painting, commercial painting, exterior painting, interior painting, deck staining and sealing, pressure washing, surface preparation, molding and trim, carpentry, rotted wood replacement, and related property services that may be offered by participating locations.

University Painters locations may be independently owned and operated. The specific company, licensee, contractor, or local business that provides an estimate or performs work for you may vary by service area. Your service agreement, proposal, estimate, work order, invoice, or other written contract with the applicable local provider controls the details of your project.

3. Website Information Is Not a Binding Offer

The content on the Site is provided for general informational and marketing purposes. Descriptions of services, service areas, availability, promotions, guarantees, discounts, financing references, reviews, project examples, photos, and pricing-related statements are not binding unless confirmed in a written estimate or contract from the applicable local provider.

We may update, correct, remove, or change Site content at any time without notice. We do not guarantee that all information on the Site is complete, current, accurate, or applicable to your property or project.

4. Estimates, Proposals, and Project Scope

Any estimate, quote, proposal, or consultation request submitted through the Site is a request for information only. It does not create a contract or obligation for either party unless and until a written agreement is accepted by both you and the applicable local provider.

Project scope, price, payment terms, materials, colors, start dates, completion dates, warranty terms, cancellation rights, and other project-specific terms must be stated in the applicable written proposal or service agreement. If there is a conflict between these Terms and a signed project agreement, the signed project agreement controls for that specific project.

5. Scheduling, Access, and Property Conditions

Service dates and appointment windows are estimates unless expressly stated otherwise in writing. Weather, product availability, permitting, customer readiness, property conditions, labor availability, safety issues, and other factors may affect scheduling.

You are responsible for providing safe and reasonable access to the property, securing pets, moving fragile or valuable items, identifying known hazards, disclosing water damage, structural issues, lead-based paint concerns, mold, asbestos, rot, pest issues, electrical issues, or other relevant conditions, and obtaining any required permissions from property owners, homeowners associations, landlords, tenants, or other parties.

6. Customer Representations

By requesting services, you represent that you are at least 18 years old and have the legal authority to request information, approve work, and make decisions regarding the property or project. You agree to provide accurate, complete, and current information when using the Site or communicating with us.

You agree not to submit false information, impersonate another person, interfere with Site security, attempt unauthorized access, or use the Site for unlawful, abusive, deceptive, or harmful purposes.

7. Payments, Deposits, and Invoices

Payment terms, deposits, progress payments, final payments, financing, late charges, returned payment fees, and collection-related terms are governed by the applicable written estimate, contract, invoice, or financing agreement.

Unless otherwise required by law or stated in writing, promotions, coupons, discounts, and special offers may be limited by location, service type, project size, eligibility, availability, expiration dates, and other restrictions. Offers may not be combined unless stated in writing.

8. Cancellations, Delays, and Changes

Cancellation rights and procedures may vary by state, project type, and agreement. Any applicable right to cancel will be provided in the written contract or notice required by law.

Changes to project scope, colors, materials, access requirements, repairs, hidden conditions, or customer requests may require a written change order and may affect price and schedule.

9. Materials, Colors, and Product Variations

Paint colors, stains, finishes, textures, sheens, materials, and product appearances may vary due to lighting, surface conditions, age of existing materials, digital screen settings, manufacturer changes, prior coatings, and normal application differences.

Color samples, website images, renderings, project galleries, and marketing photos are examples only and do not guarantee an exact match or result. Final product selection and approval are your responsibility unless otherwise stated in writing.

10. Workmanship, Guarantees, and Warranties

Any workmanship guarantee, satisfaction guarantee, product warranty, manufacturer warranty, or service warranty applies only if provided in writing by the applicable local provider or product manufacturer. Warranty terms, exclusions, transferability, duration, and claim procedures may vary by location and project.

Unless expressly stated in a written agreement, warranties do not cover ordinary wear and tear, abuse, neglect, moisture problems, structural movement, failed prior coatings, customer-supplied materials, acts of nature, mold, mildew, rot, pest damage, leaks, substrate failure, or conditions beyond the provider’s control.

11. Photos, Reviews, and Project Content

If you submit reviews, testimonials, comments, photos, videos, or other content to us, or if you permit project photos or videos to be taken at your property, you grant University Painters and participating local providers a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, publish, display, and distribute that content for marketing, advertising, training, portfolio, and business purposes, unless prohibited by law or agreed otherwise in writing.

We may remove names, addresses, personal details, or identifying information when practical, but you should not submit content that includes confidential, private, or sensitive information.

12. Communications, Calls, Texts, and Emails

By submitting your contact information through the Site, you authorize University Painters, participating local providers, and their service partners to contact you regarding your request, estimate, project, appointment, account, review, or related services by phone, email, text message, voicemail, or other reasonable methods.

Message and data rates may apply. Consent to marketing communications is not a condition of purchase. You may opt out of promotional emails by using the unsubscribe link where available. You may opt out of text messages by replying STOP, if that option is provided. Service-related messages may still be sent when permitted by law.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Site, you consent to the collection and use of information as described in that policy.

If the Site links to third-party tools, forms, review platforms, scheduling tools, advertising platforms, payment processors, maps, analytics tools, or social media sites, those third parties may collect information under their own terms and privacy policies.

14. Intellectual Property

The Site and its content, including text, graphics, logos, names, photos, videos, icons, service descriptions, page layouts, and other materials, are owned by University Painters, its affiliates, local providers, licensors, or content suppliers and are protected by intellectual property laws.

You may view and print reasonable portions of the Site for personal, non-commercial use. You may not copy, reproduce, scrape, modify, distribute, sell, reverse engineer, or exploit the Site or its content without written permission.

15. Third-Party Links and Tools

The Site may include links, widgets, embeds, maps, forms, reviews, social media features, or other tools provided by third parties. We do not control and are not responsible for third-party websites, content, services, security, availability, accuracy, or privacy practices.

Your use of third-party sites or tools is at your own risk and may be governed by separate terms and policies.

16. No Professional Advice

Information on the Site is not professional construction, engineering, architectural, environmental, financial, legal, insurance, or safety advice. You should consult appropriate professionals for advice specific to your property, project, budget, legal rights, or obligations.

17. Disclaimer of Website Warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties related to the Site, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the Site will be uninterrupted, error-free, secure, virus-free, or available at all times.

18. Limitation of Liability

To the fullest extent permitted by law, University Painters, participating local providers, affiliates, owners, officers, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising from or related to your use of the Site or reliance on Site content.

To the fullest extent permitted by law, our total liability for claims related to the Site will not exceed one hundred dollars ($100) or the amount you paid directly to us for use of the Site, whichever is greater. This limitation does not limit any rights or remedies that cannot be limited under applicable law or under a separate written service contract.

19. Indemnification

You agree to defend, indemnify, and hold harmless University Painters, participating local providers, affiliates, owners, officers, employees, contractors, agents, licensors, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your use of the Site, your violation of these Terms, your submitted content, your property-related representations, or your violation of another person’s rights.

20. Dispute Resolution and Governing Law

These Terms and any dispute related to the Site are governed by the laws of the state in which the applicable University Painters location or local provider involved in the dispute is located, without regard to conflict-of-law rules, unless applicable law requires otherwise.

Any project-specific dispute may be governed by the written agreement for that project, including any venue, mediation, arbitration, warranty, notice, or claims procedure stated in that agreement. Nothing in these Terms limits rights that cannot be waived under applicable consumer protection, home improvement, contractor licensing, or other laws.

21. Changes to These Terms

We may update these Terms at any time by posting a revised version on the Site. The “Last updated” date will indicate when the Terms were most recently revised. Continued use of the Site after changes are posted means you accept the revised Terms.

22. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
